Texas Point System and Other Useful Info

Texas “Point System”
Texas “Point System” Effective September 1, 2003, Texas implemented a "Points System"! Points are assessed to a person's driver license for moving violations classified as Class C misdemeanors, and effective September 1, 2005, Child Safety Seat Violations are identified as moving violations. DPS will assess a surcharge when the driver accumulates a total of six (6) points or more on their driver record during a three-year period. The driver must pay a $100 surcharge for the first six points and $25 for each additional point, in addition to any related services fees. Traffic offenses which result in points are designated in the chart at 37 TAC §15.89.

The following is a quote from the DPS webpage concerning the Driver Responsibility Program: "The Driver Responsibility law (TRC Chapter 708) was enacted by the 78th legislative session (Subchapter B of House Bill 3588) and establishes a system that assesses surcharges based on certain traffic offenses. DRP only applies to offenses that occurred on or after September 1, 2003. This program does not replace other administrative suspension, or revocation actions that result from these same convictions. The surcharges assessed for this program are in addition to other reinstatement fees required for other administrative actions."

According to Section 708.052, Texas Transportation Code, "For each conviction arising out of a separate transaction, the department shall assign points to a person’s license as follows:

(1) two points for a moving violation of the traffic law of this state or another state that is not described by Subdivision (2); and

(2) three points for a moving violation of the traffic law of this state, another state, or a political subdivision of this or another state that resulted in an accident."

DPS may not assign points to a person's driver's license if the offense is that of speeding and the person was at the time of the offense driving less than 10 percent faster than the posted speed limit, or if the offense was adjudicated by the court under Article 45.051 or Article 45.0511, Code of Criminal Procedure; that is, the driving safety course or the deferred disposition laws.
Online Course Driver Training Information
Texas Education Agency has approved the delivery of specific driving safety courses via alternative delivery methods (ADM) such as the Internet.

If you take a course via an ADM (that is, not in a classroom), an instructor will not be present. In order for the ADM to receive Texas approval, it must meet the requirement of law that it "includes testing and security measures that are at least as secure as the measures available in the usual classroom setting". Therefore, periodically during the course, you will be asked personal questions such as "Is the vehicle you normally drive a 2-door, 4-door, pickup, or other?" These questions, which often use third-party databases to verify your answers, are designed to ensure Texas Education Agency has approved the delivery of specific driving safety courses via alternative delivery methods (ADM) such as the Internet.

If you take a course via an ADM (that is, not in a classroom), an instructor will not be present. In order for the ADM to receive Texas approval, it must meet the requirement of law that it "includes testing and security measures that are at least as secure as the measures available in the usual classroom setting". Therefore, periodically during the course, you will be asked personal questions such as "Is the vehicle you normally drive a 2-door, 4-door, pickup, or other?" These questions, which often use third-party databases to verify your answers, are designed to ensure the identity of the person who is completing the ADM, and you will also be asked course content questions to ensure that you are viewing and absorbing the material. These personal validation questions and/or course content questions may be sent to you via a random pop-up window which expects an answer via the computer, or they may be sent by a notice to stop and call a toll-free number or go online to a specific website. There may also be a time limit such as 30 or 60 seconds for you to answer each question after it is presented to you.

At your discretion, you may break up an ADM's online course into segments of almost any length, and the course will provide instructions on exiting and re-entering the course at that same point. You may also take the course via those means at any time of day or night, and there is a 24 hour-a-day help line available. You will be given that toll free number to call if you need technical assistance or have a question about the course content.
Insurance Discount Driver Training Information
Although no longer required to do so, some insurance companies will provide a discount (usually 10%) for three years on the liability portion of your auto insurance premiums if you provide proof of completion of one of the driving safety courses listed. However, the amount of the discount (if any) and the driving safety courses that an insurance company will accept are strictly up to that insurance company, so you'll need to check with your insurance agent.

Even if you don't need to dismiss a traffic ticket, you are permitted to take a driving safety class to obtain a discount on your automobile insurance. Some people obtain that insurance discount by attending a driving safety class along with a spouse or a friend who received a ticket. NOTE: Check with your insurance agent to confirm that your insurance company will provide a discount on your auto insurance before you take a class for that purpose.

If your insurance company has decided to provide a discount on the liability portion of your automobile insurance for completing a driving safety course, that discount will usually be provided regardless of the reason that you took the course. That is, whether you take a driving safety course for pure education, insurance discount, or for ticket dismissal, the insurance company will normally give you the insurance discount. It is the same 10% that a teen might receive for successfully completing a driver education course, and the two discounts are not additive; that is, most insurance companies won't give you a 20% discount for completing both courses. However, a 15% discount may be achieved by also completing a DADAP course (See).
Ticket Dismissal Information
If you have a Texas driver license or Permit and meet certain other requirements, Texas state law allows you to dismiss one traffic ticket every 12 months by taking a TEA-approved driving safety (a.k.a. defensive driving, traffic safety, or ticket dismissal) course.

In order to dismiss a traffic citation by taking one of these classes, Texas law requires the following: you must NOT possess a Commercial Driver License (CDL); you must admit guilt or sign a statement that you do not contest the citation (nolo contendere); and if you were charged with speeding, you should not be permitted to dismiss the ticket if you were cited with driving 25 or more miles per hour above the posted speed limit. There are other criteria, and the court has the final decision on whether you'll be permitted to dismiss the ticket by completing a driving safety course.

Most municipal court judges and justices of the peace require you to contact the court before you take the driving safety course for purposes of ticket dismissal. Be sure to obtain the court's permission first. By contacting the court that is indicated on your traffic ticket, you may prevent delays, added expenses, or a requirement that you repeat the course.

If the municipal court or the justice of the peace charges a court fee for you to take a driving safety course, and if they require you to a copy of your driving record from the Department of Public Safety (DPS), those fees are in addition to the price that you will pay for the driving safety course.

A certificate of driving safety course completion cannot be saved and used for a later traffic violation. You must complete the driving safety course AFTER the traffic violation, and the court may dismiss only one charge for each completion of a course. [Code of Criminal Procedure, Art. 45.0511].

If you are dismissing a traffic ticket, you will be required to identify the name of the court that has jurisdiction (it's on your traffic ticket). Then when you receive your completion certificate, that court name will appear on the certificate. If you put the wrong court name on the enrollment form (or no court name at all) and need another certificate with the correct court name, you MUST return the original certificate before you can receive a corrected certificate. If you take a driving safety class purely for education or to receive an insurance discount, then later receive a traffic ticket, you may be permitted (at the judge's discretion) to take another driving safety class to dismiss the ticket if you haven't done so for ticket dismissal within 12 months of the date of the offense. House Bill 183 (79th Regular Session) changed the law to allow a person who receives two traffic citations (one of which is a seat belt offense) to dismiss both the regular traffic citation and the "seat belt" citation by completing both of those 6-hour courses within the same 12 month period.

If you receive a traffic ticket in another state and want to avoid points on your Texas driver license by taking a driving safety class (defensive driving class), the decision to allow you to do so is strictly up to the judge who has jurisdiction of your case. Texas has no reciprocity with other states concerning driving safety classes, and because some of the topics in the Texas courses are unique to Texas; for example, "The five leading causes of motor vehicle crashes in Texas", "Don't Mess With Texas", and "The Danger of Railway Crossings in Texas", a Texas driving safety course may not be acceptable for ticket dismissal in that other state. Also, there are some states that don't offer the opportunity of dismissing a ticket by taking a driving safety course.

Conversely, if you have a driver license from another state and receive a traffic ticket in Texas, you may (with the Texas judge's permission) be allowed to take a Texas driving safety course to dismiss that ticket - it's up to the judge. If the judge approves you to complete a Texas driving safety course for that purpose, you can take it outside of Texas via one of the approved online courses.
Exception for Active Duty Military Personnel
House Bill 370 was passed in the 79th Regular Session concerning a person on active military duty who receives a traffic citation but does not have a Texas driver license. Effective September 1, 2005, that military member is permitted to dismiss a Texas traffic ticket by taking a TEA-approved driving safety course if he or she has not completed a driving safety (or similar) course for ticket dismissal in another state within the 12 months preceding the date of the offense.
