Texas Ticket Dismissal
The 6 Hour Defensive Driving course (a.k.a. DD) is commonly referred to as "Defensive Driving".
If you have a Texas Driver License or Permit and meet certain other requirements, Texas state law allows you to dismiss one traffic ticket per year by taking a TEA-approved driving safety course (the Course offering by Texas Defensive Driver - an American Safety Council affiliate is a TEA-approved driving safety course.
Thus, if you were charged with a moving violation, you may be able to have this charge dismissed by taking a Texas Driver Safety / Defensive Driving Course. The following parameters must be met for driving safety course ticket dismissals:
- The cited person must not possess a Commercial Driver License (CDL).
- The cited person must either plead guilty or agree not to contest (by pleading nolo contender) by signing an affidavit or other court-approved document.
- The cited driver must not have been cited for speeding in excess of 25 miles per hour above the posted speed limit.
Your successful completion of Texas Defensive Driver's Texas defensive driving class will entitle you to a certificate that Texas courts may honor to dismiss a traffic ticket.
When you present the course completion certificate to your insurance agent, most insurance companies will grant you a 10% discount on the liability portion of your automobile insurance for three years.
How To Request Defensive Driving Course
To qualify for a Defensive Driving course you must present to the court on or before your appearance date the following items:
- A notarized statement stating that you have not completed the Defensive Driving course in the past twelve (12) months.
- Proof of financial responsibility and be listed as a driver on the policy or insurance card.
- A valid Texas drivers license.
- A plea of no contest or guilty.
Upon completion of the Defensive Driving course, the cited driver will receive a completion certificate that must be signed to acknowledge completion of the entire 6-hour course.
These benefits are important because:
- Out of pocket expenses for the ticket are less.
- No points on your license = No increase in your insurance rates.
- Many drivers will be able to keep their Safe Driver status, others will keep licenses clean for employment purposes, others don't want to have a permanent record of a charge they felt they were not guilty of on their record… having adjudication withheld achieves all of these.
